Partial Birth Abortion: Supreme Court Opinion

An 8 page overview of Stenberg v. Carhart, a case coming before the Supreme Court in April, 2000. The case involves the privacy issues of abortion. An overview of provided on numerous Court decisions which are applicable to the case including Hodgson v. Minnesota, Ohio v. Akron Center for Reproductive Health, Planned Parenthood v. Casey, Roe v. Wade and Webster v. Reproductive Health Services. Traces the privacy issues dating back to the turn of the century and conclude that these previous findings should be upheld in Stenberg v. Carhart as well. Relates the "undue-burden" issues surrounding state regulation of abortion and presents the opinion that is only when a fetus has reached that stage in its development where it could live outside the body of its mother that the state can claim an interest in preserving the life of that fetus. Partial Birth Abortions

5 pages in length. Considered by some to be nothing more than a veiled lack of responsibility, partial birth abortions have come to the forefront of controversy. As if abortion, in and of itself, was not a hot enough issue for debate, both the procedure and reasoning behind partial birth abortion are under fire. Women whose fetuses have known birth defects most commonly utilize this highly invasive procedure as a means by which to terminate the late-term pregnancy. After the baby is purposely turned in the breach position, the doctor pulls it down through the birth canal until the only part left inside the mother's body is the head, which legally maintains its fetus status. The brain is then suctioned out and the skull crushed before the body is completely expelled. Indeed, the primary arguments about this particular procedure revolve around the status of personhood, as well as the reasons to even employ such a horrific alternative. Bibliography lists 4 sources.

Patricia L. Hunter's "Women's Power - Women's Passion"

Hunter raises questions that have been asked for centuries; through her insightful analysis, the reader is able to gain a significantly better understanding of just how patriarchal and hypocritical religion is as a whole. That women were to also be made in God's image brings to light the notion of gender superiority, inasmuch as there should be no separation between male and female when it comes to one gender oppressing the other. The author continues by pointing out that not only does such a dominance exist, but there are also subgroups of women who are considered even less worthy than others, with African-Americans considered one of the lowest of all female gender subgroups.
